Can you apply for a residence permit for a Spanish nomad on a tourist visa?
Yes, if the stay in Spain is legal, the basis: Article 74 quinquies Ley 14/2013 allows for requests for a residence for telework on topics such as "que se Hallen en España de forma regular" (in Spanish legally), or on a teletrabajo visa. [1]The application is made by the Unidad de Grandes Empreas y Colectivos Estratégicos (UGE) under the Ministry of Inclusion, which only applies electronically. [1][5]The consulate in Moscow writes the same: those in Spain are legally entitled to apply to UGE without a prior visa [7]The reservation: it is with a short-term visa that the law refers to the legal presence in Spain, and as UGE applies to short-term visa holders, we have not checked publicly.
The law calls "Turistic visa" visado de estancia de Corta Duración, a short-term visa of type C. If your citizen does not need a visa, you are in the situación de estancia sin visado. The rule for both cases is one: no more than 90 days in any period of 180 days. Prórroga de estancia and the UGE: how they differ
The two procedures are constantly confused. The Prórroga de estancia (renewal of short-term stay) is a separate application by the police, with its grounds. [1].

The conclusion is simple: the prórroga does not take "for reserve." You have to apply to the UGE while the stay is legal. Article 20.4 Reglamento (Real Decreto 1155/2024) requires parking people to leave within its time limit unless they apply for a residence permit. [2].
How to apply for a residence permit for a nomad from Spain: the order of steps
- Count the days: all entry and exit to Schengen in the last 180 days, visa period, 90 days. [2][12]I. Documents, translations and apostilles are better collected before entry: you have to file while stay is legal.
- Collect UGE package: MI-T form, copy of passport whole, contract or contract for at least three months, foreign company register (at least one year of work), employer letter, income confirmation, social security documents, certificate of non-judiciality, medical insurance, diploma or experience [4]I'll give you more details: conditions Digital Nomad.
- Pay the fee: Form 790, code 038, 73.26 I online, attach the receipt to the application [3][4].

What about the job while the application is under consideration?
This is the most controversial place, and the law extends "situación de estancia": you remain in the guest's position, not the resident's. [1]The right to work only gives permission. in UGE alta documents in Seguridad Social and the beginning of activities in Spain are tied to the time after the authorization is granted. [4]. In its explanations, UGE calls work without permission a violation, although the example there is another: the holder of no lucrativa, who worked remotely <x {x} in the contract and less than the term of the "10> [3]. The administrative framework is as follows: working in Spain without a work permit in the absence of a valid residence permit is a serious violation, a fine of 501 to 10,000 euros. [9].
As the agency looks at the remote work of a foreign employer during the review period, it is not stated in open sources, but we do not assume that applying for work itself, and we resolve the matter individually with you.
One Schengen visa for Russians: what changed after November 2025
Decision C(025) 7552 of 6 November 2025 restricted multiple short-term visas for Russian citizens who live in Russia and file documents with the consulates of the Schengen States in Russia [6]B. The general rule is that the number of visas is multiple: the closest relatives of EU citizens or Russians legally resident in the EU (for a year when three visas have been obtained and legally used in two years) and the transport workers (for nine months, with two visas) [6]States may make an exception in justified cases [6].
The result for our subject is that you enter once with a single visa. If you leave Spain before the UGE decision, you cannot return on the same visa. The decision of the European Commission does not concern applications filed outside Russia, nor does it speak of leaving during the UGE application. We did not find such a rule in open sources, so plan to leave without having to leave. The decision concerns only Russians who submit in Russia. The Consulate of Moscow calls it a mandatory Schengen visa for citizens of Belarus, Armenia, Uzbekistan and Turkmenistan. When a Spanish pitch is a bad idea
- Legitimate days aren't enough, and the package isn't ready. Some of the documents come from the country of residence: a certificate of non-judiciality with apostille, an extract from the company register, if it takes weeks to receive and translate them and the parking is over, it is safer for the consulate.
- Staying is illegal. One of the general requirements is that not being in Spain irregularly (art. 62.3 (a)) and the irregular parking itself is considered to be a serious violation [1][9]The way is with a lawyer.
- You live on no lucrativa and you work remotely. UGE writes that no lucrativa does not allow work and work without permission is not an offence, so it is not possible to refer to this period as a "extracted work experience" [3].
- We have to go back and forth. A single visa and a UGE application are not well matched with travel.
- The employer is not ready to register with the Spanish Seguridad Social. For a staff member who is hired, this is usually a condition of application; more specifically in the article on social insurance without A1.

Typical errors in the Spanish application
- Count 90 days only for Spain or from one date of entry; take into account days in all Schengen countries and 180 days of sliding window: counted back from each day of stay [2][12].
- Take prórroga de estancia instead of applying: it has exceptional reasons and another authority [2].
- To deliver a parking package in the last days. The general rule on request gives 10 days [10], and this is shorter than it seems.
- Start work in Spain before the decision.
- Forget that you need a certificate of non-judiciality from the countries where you've lived for the last two years, plus a five-year statement. [4].
- To go for a "seal" on a single visa without finding a way back.
