Deadlines in UGE and extranjería: calendar for each stage

The main time frame is 10 days to reply to requerimiento, 10 calendar days to "deletion" of unread notice, 1 month to appeal the refusal, 2 months to trial, counted from the day after the notice.

What are the deadlines in UGE and expanjería?

UGE (Unidad de Grandes Empreas y Colectivos Estratégicos) applies for Ley 14/2013, including a permit for a digital nomad. Extranjería, i.e. Oficina de Extrajería under Subelegación del Gobirno, has a general regime under Real Decreto 1155/2024. Partly general (administrative law), part of its time frame is different; lower is what we have verified by the laws.

It's a calendar by law; the time frame in your decision or requerimiento may be different.

What are days and months considered?

Days are considered working unless the law says otherwise: Saturdays, Sundays and holidays are not counted, and the countdown begins on the day after notification [2]A day not working in your municipality or in your place of authority is not counted either. [2].

Months are considered calendar and end on the same number day: notification 15 October, month expires 15 November. [2]. August is not considered in court terms (Article 128 Ley 29/1998) [3]It is usually considered administrative.

Article 76 Ley 14/2013 writes about UGE "veinte dias" without the word "hábiles." As a general rule, these are working days, but as the UGE itself believes, we do not know. [1][2].

What day does the deadline run after the notice?

From the day after the notification took place [2]The electronic notice is considered to be delivered when you have opened it in sede or in Dirección Electronica Habilita \nica. If the notice is mandatory or you choose to use the electronic method and have not opened it, it is rejected after 10 calendar days, and the deadline is still running. [2].

So the notification box needs to be checked, not wait for the letter: the mail just warns, and if it's not sent, the notice is still valid. [2]The notification in the second D.O.I. is available via the same certificado digital or Cl@ve with which you applied [5].

What's stopping the deadline at the department?

The decision of the agency is suspended when it requests your documents, from notification requerimiento to your reply or to the end of the reply period [2].

What if the deadline is missed?

The consequences depend on the type of time frame:

  • request not answered: the application is considered withdrawn after a separate resolution [2];
  • Appeal later than the deadline: the agency or court rejects it as being filed not on time, but as final [2][3];
  • Extension: The application is extended 90 days after the end of the permit by DNV, but the agency may commence the sanctions proceedings [1]; in general mode, the same rule applies for application within three months of the end [4];
  • TIE: breach of card obligations is sanctioned under LO 4/2000 [4].

If the deadline is up or about to come out, show the lawyer the same day.

How do you build a personal calendar?

  1. Write down the date of delivery and the registration number from the sede receipt.
  2. For each notification, write down the date you opened it, not the date of the letter.
  3. Add a time frame from the table by skipping Saturdays, Sundays and holidays of Barcelona and Madrid, if you count in the days.
  4. Put a reminder in three working days to the end and hold copies of all confirmations.

Frequent issues

How many days do you have to answer the requerimiento?
As a general rule, 10 days and may be extended at the request of a maximum of 5 days if it is particularly difficult to collect documents (art. 68 Ley 39/2015). The actual deadline is the same as the requester may refuse an application without a reply, and a separate resolution decides. [2]
What happens if you don't open an electronic notice?
If the electronic form is mandatory or you choose it, 10 calendar days from the time the notice is received, it is considered rejected and the time limit goes on (art. 43 Ley 39/2015). Open the sede or Carpeta Ciudadana regularly and make arrangements for who does it for you. [2]
When do you want to apply for a DNV extension?
If you have a TELL visa, the application for a permit is filed within 60 calendar days before the end of the visa (art. 74 quater). To extend the permit itself, the law states that the application is extended, including the application submitted 90 days after the end. The window "before" is not mentioned in the text of article 76. [1]
Are Saturdays and holidays considered on time?
There are no dates in the days: Saturdays, Sundays and holidays are not counted unless the law says otherwise (art. 30 Ley 39/2015). Months are counted according to calendar and end on the same number day. You or the organ do not have a day off. [2]
How long is it to challenge a residence permit?
A month at recurso de alzada or reposición, if you are administratively involved, and two months at trial from the moment the refusal is completed (art. 122 Ley 39/2015, art. 46 Ley 29/1998). What is your path, depending on who made the decision. [2][3]
Can you apply for an extension after the permit is completed?
The law allows an application 90 days after the end of the DNV permit and extends it until the decision, but the agency can start the sanctions proceedings (art. 76 Ley 14/2013). Whether the case will be successful, the lawyer or the Gestor decides: Show the documents before the deadline expires. [1]
