How many days can you stay in Spain without a residence permit?

The term "reglamento de extrandjeria" (Real Decreto 1155/2024, in force since 20 May 2025) defines short-term stay as stay in Spain for no more than 90 calendar days in any period of 180 days and uses the words "a partir de la fecha de la primera entrada en el Espacio Schengenen". (EU) 2016/399 on border crossing and a sliding window (see below) [1][6]I. The visa entry is also restricted to the visa period [1].

The Basic Law on the Rights of Aliens, Ley Orgánica 4/2000, gives the same frame: "estancia" - stay not exceeding 90 days, after which it is necessary to obtain an extension of stay or residence permit for a stay in Spain [3]The European Commission formulates the same rule for the whole of the Schengen area: you can enter as many times as possible, but not more than 90 days in any 180 days. What are 90 and 180 days considered?

The 180-day window is not calendar, but "anything": they check any 180-day segment. [1]The practical conclusion is that the meter does not leave the day and return while the previous days are within 180 days.

Can you extend your stay beyond 90 days?

For a visa-free stay, article 49 Reglamento allows prórroga de estancia up to three months beyond the initial period if the conditions of article 20 of the Schengen Convention are met. The application is: passport, proof of exceptional reasons, funds for extension, insurance and guarantees of return. Identification must be made in person at the Policya Nacional. If no reply is given, the application is considered rejected. [1].

For short-term visas, article 32 allows for extensions for humanitarian reasons or force majeure, as well as for serious personal reasons; the total duration, including extension, may not exceed 90 days out of 180 days [1]I. More detailed on the Institute: prórroga de estancia.

What happens if you stay longer than 90 days?

Article 53.1.a Ley Orgánica 4/2000 makes it a serious offence to be in Spain without an extension of stay or a residence permit. Article 55 imposes a fine of between 501 and 10,000 ya. Article 57.1 allows for expulsion on the basis of proportionality, after separate proceedings, instead of a fine; fines and expulsions are not simultaneously imposed.
