ICT visa to Spain: intra-corporate translations and conditions

ICT (intra-company transfer) is a temporary transfer of a staff member to a Spanish company of the same group, which is subject to articles 73 and 74 Ley 14/2013 through UGE, applied by a Spanish organization, not by the employee himself.

ICT visa to Spain: what it is and for whom

The law defines: the director is in charge of the company or its branch, the specialist has special knowledge of the activities, techniques or management, the intern is a university graduate who is being directed to learn company methods for remuneration [1]Examples of national model on the UGE page: transfer of employees to perform a contract between a Spanish and a foreign company and a professional relationship transfer [3].

Conditions for obtaining ICT

In addition to the general requirements of article 62, the law specifies four special conditions (art. 73.2) [1]:

  • There is real activity of the company and, if applicable, groups;
  • The employee has a higher education equal to at least the 1st level of the Spanish Qualification Framework (MECS) or a three-year experience that can be equated to such qualifications;
  • He had prior and continuous contact, whether in employment or in employment, with one or more of the group ’s companies, for at least three months;
  • I have company documents to confirm the transfer.

Who applies and in what order

Duration, validity and extension

The Act sets out short periods: visas for 10 working days (if no consultation on the Visa Code is required), 20 days [1]The applicant ’s legal stay or residence is extended until the decision is reached [1]. If the foreign company you work for remotely has an office in Spain, UGE does not consider you teletrabajador (DNV): it is a transfer within the company and the requirements of ICT apply. [5]III.
