Student's family in Spain: estancia for spouse and children

The Spanish student family (spouse or partner, children) receives estancia under article 56 of the regulations only if the main student is enrolled in higher education or specialized medical training, and is attached to the student status and cannot work on it.

Who has access to family estancia

Article 56 of the Regulations (Real Decreto 1155/2024) refers to the families of the estancia holders under article 52.1 (a): higher education in the face or hybrid programme leading to a recognized diploma, which also applies to the families of those who receive specialized medical training under article 58 [1]If a student is enrolled in school, post-compulsory secondary education or language courses, no family is registered under article 56 [1][2]Therefore, buying a regular language course does not mean the right to bring a family under the same scheme.

The parents of the student are not included in the list, nor are adult children without special needs. For such relatives, another reason must be found. To confirm marriage, registration or birth, a formal certificate is required; differences in surnames and transliterations are explained before delivery.

Funds, insurance and documents

For each family member, a link, legal presence (if a person is already in Spain), insurance, no threat to public order, and for adults who park for more than six months, a certificate of no criminal record in the last five years in the countries of residence, must be shown. [1]The amount of money is counted for the whole family: the student confirms 100% of IPREM per month for himself, the first member of the family 75 % IPREM for each next 50% IPREM. The amount paid for the tuition is not included in the calculation, so the cost of the training does not replace the family living expenses. How to deliver: With a student or later

  1. Check the student's time. Family can serve when a student has at least 90 days of estancia action. [1][2].
  2. Choose an option. At the same time as a student, later from abroad (visa) or from Spain (authorization) if a relative is legally present in the country [1].
  3. Prepare a package for each of you. Passport, communications, funds, insurance, certificates, duties [1][2].

Work and time: What cannot and how the calendar leads

Family estancia does not allow work, which is explicitly stated in article 56.6 and Hoja 1 repeats: a student's family cannot work [1][2]The rights of the principal student (up to 30 hours a week in higher education under article 57) are not applicable to the family: Student permitTherefore, the family budget should be built without the assumption that the accompanying person will be able to earn a living, and if he has a basis for work, he should be evaluated separately, not changed by the title of the activity in the documents.

Typical Errors

  • They think that any student has a family estancia. It is a university education and specialized medical training [1].
  • They're including their parents. Article 56.2 does not name them.
  • They only charge the student. 75 per cent and 50 per cent of IPREM are for family members, and they are not covered by the tuition fee [1][2].
  • They're building a budget for their husband's work. Family estancia is not a work in progress. [1][2].
  • Forget the student's term. If there are less than 90 days left, the family won't be able to pay. [1][2].
  • They're applying DNV rules. The Ley 14/2013 family is treated differently and can work: family on DNV.

Frequent issues

If the student has extended his studies, does the family have to do nothing?
No. Family documents and their continuation require separate verification: Article 56 ties family to student status, but the procedure for extension for relatives is not explicitly described. [1]Keep a calendar for each family member and submit on time.
Can parents be brought under article 56?
No. No parent is on the student ’s family list, and only unmarried children with special support needs are included among adult children [1]For parents, it's up to you to find another basis.
