Residence permit for a digital migrant family in Spain: who enters

The family in Spain is a spouse or partner in a similar relationship, minors, adult children on maintenance and parents on maintenance (art. 62.4 Ley 14/2013). The complainant and one family member confirm 3,917 a month.

Who is a member of the family of a digital nomad's residence permit

Family categories are set out in article 62.4 of the Ley 14/2013 and apply to all permits for international mobility, including telework (DNV) [1]For each member of the UGE family, they call the indicative set of documents, it's one for all categories. [5].

Article 62.4 does not include brothers, sisters, grandparents and other relatives, but will have to find another basis for them; otherwise, the general list for any family member: completed family application form (MI-F), passport, confirmation of funds, health insurance in Spain (except for a person who is entitled to public medicine through the complainant ’s activities) and a related document [5][6]On insurance: UGE policy requirements.

A spouse and partner without marriage

The spouse confirms the connection with the marriage certificate: an official document is required, with apostille and translation if necessary [5]. In a non-marital partner, the law uses the formula "análoga relacion de actividad" and does not specify anything else. [1]. UGE in the indicative list calls "certificado de convivencia" (certificate of cohabitation) [5]. In Barcelona, a similar document gives out Ajuntament (volant de convivència), but whether the UGE accepts it for DNV is not specified in the sources.

By comparison: the general RD 1155/2024 regulation on reunification with a resident accepts a partner if the couple is entered into the public register of the EU State or you prove a stable connection, including 12 consecutive months of living together, or you have a common child; marriage, registered couple and a proven stable couple are considered incompatible [4]The couple in Catalonia on Código Civil de Cataluña are considered stable if you have lived together for more than two years, have a common child or have a notarized relationship (art. 234-1 Ley 25/2010) [7]. Recording in Registre de parelles is voluntary and does not create a pair on its own [8]Whether UGE applies the RD 1155/2024 criteria for DNV, we have not found, so do not count on a Catalan document alone without verification. marriage or pareja de hecho and Pareja de hecho in Catalonia and residence permit.

Children: minors and over 18

Juvenile children included without age conditions except for the general requirement of kinship [1][5]If a child is travelling with one parent, prepare the custody documents and consent of the second parent. For reunion with a resident, where the child is only one of the spouses or partners, the regulation requires that the parent alone hold parental authority or the second parent consents to the move. [4]We didn't find such a rule for DNV in Ley 14/2013, but the travel permit documents are reasonable.

Children over 18 are only part of the complainant ’s family if they are economically dependent on him or her and have not established their own family (art. 62.4). [1][5]Which documents are convincing (translation notes, content contract, learning certificate and lack of income) not listed in the sources; it is useful to show a stable dependence rather than a one-time transfer; for the general regime, the regulation defines dependence as real, stable and pre-application. [4].

The complainant ’s parents and his partner

Parents are included when they are in the care of the applicant (ascendientes a cargo) [1]. Ley 14/2013 does not define this formula. At Mercurio, lawyers, gestores administrativos and graduados sociales work through their professional access after registering with the relevant Consejo General [5]Article 196 of RD 1155/2024 explains that the content means real and stable material assistance: economic dependence, which must be real, stable, not ad hoc and exist before the application is made, or physical dependence on health condition. By decision of the Tribunal Supreme Supreme of 8 July 2026, the reservation that a dependency must exist in the country of origin was removed from article 196. [4]These rules are written for regulations, and if UGE applies them to DNV, we haven't found them.

If the criteria for the regulations are to be applied, parents living abroad will need bank transfers one year before filing, documents of their income and confirmation that they have no other support in their country of residence, as well as a birth certificate for the applicant. How much income a family needs

The threshold is considered SMI: the complainant is 20%, the first family member is 75%, each 25% [2][3]The monthly amounts are the annual figure divided by 12, gross, by 01.10.2026.

The amount of money paid to the spouse or child is equal to the amount of the first and the next. Children and parents are also considered to be family members at the threshold. How to apply for a family: order

  1. Whether to file with the main application or later, the law allows both options; if simultaneously making a decision, they are adopted simultaneously. [1].
  2. Collect for each family member a MI-F form, a passport, confirmation of funds, insurance and affinity (with apostilles and translations) [5][6].
  3. Pay the 73.26 I for each initial bid, and there's a need for confirmation of payment. [2].
  4. Apply electronically through the Ministry ’s website: applications and documents on Ley 14/2013 are accepted only electronically, digital certificate required [6].
  5. Follow the notifications: the time limit for UGE decision is 20 days, and silence means a positive decision, further in the article on the UGE time frame [1].
  6. After approval for authorization longer than six months each requests TIE personally (Article 76.2 Ley 14/2013) [1].

These regimes are not mixed: each member of the family is processed according to the standard that fits his or her case. on family reunification, on the map of a member of the family of an EU citizen and on reunification with the spouse.

Typical Errors

  • Consider the threshold only for the applicant and forget to add 75% and 25% for family members [2][3].
  • They believe that a spouse can be filed later without his or her own documents: each has his or her own full set under article 62.3. [1].
  • Relying on "civil marriage" without a document: UGE calls certificado de convivencia or other confirmation [5].
  • Take documents for an adult child only about the relationship, without proof of dependence or absence of a family [5].
  • Include in the application of brother, sister or other relatives for whom no place is available in article 62.4 [1].
  • Pays the fee only for the applicant: it is also required for every member of the family. [2].
  • They don't check if the child needs a move document when one parent leaves.

Frequent issues

Can a spouse obtain a residence permit with a digital nomad?
The spouse is a member of the family under article 62.4 Ley 14/2013 and may apply with or after the applicant for a form, passport, confirmation of funds, insurance and marriage certificate. [1][5]I'm paid for each initial application. [2].
Can a partner without a marriage apply for a residence permit as a member of the DNV family?
